Law firms are increasingly becoming targets of lawsuits,
according to the latest "Profile of Legal Malpractice Claims" a study
published by the American Bar Association´s
Standing Committee on Lawyers´ Professional
Liability. The study recorded 36,844 claims against lawyers
between 1996 and 1999, versus 19,158 claims in a previous study
for 1990 through 1995. The most recent study reported that 6,686
lawsuits against lawyers were settled, versus 4,897 suits in the
earlier study.
Of those lawsuits that went to trial, there were 289 judgments
for the plaintiffs in the most recent study compared to 29
judgments for the plaintiffs in the earlier study. According to
the most recent study, 13.8 percent of the claims resulted in
payouts by lawyers or law firms of more than $10,000.

The policy is claims made, not claims made and reported,
which means insureds can report a claim after the expiration of
the policy period as long as they continue to renew with
Chubb.
In addition to the traditional legal services, the definition
of professional services includes escrow agent, arbitrator or
mediator, government affairs advisor or lobbyist, and title
agent.
The expanded definition of claim includes written demands for
arbitration, appeals, and disciplinary or grievance proceedings
before a court or bar association.
The definition of wrongful act is broad.
Chubb promptly advances defense costs, and the insured may
retain counsel of its own choosing.
There is an exception to the insured versus insured exclusion
for intra-firm representation.
The definition of insured person includes any past, present,
and future person or entity whose labor or service is engaged by
and directed by the firm to perform professional services.
There is no retention for disciplinary and grievance
proceedings.
The definition of loss not only includes punitive damages
where permitted by law, but also has most favorable jurisdiction
language.
There is an exception to the exclusion regarding the insured
person providing service on behalf of any entity other than the
firm which provides coverage for service for a nonprofit
professional legal association.
