Law firms are increasingly becoming targets of lawsuits, according to the latest "Profile of Legal Malpractice Claims" a study published by the American Bar Association’s Standing Committee on Lawyers’ Professional Liability. The study recorded 36,844 claims against lawyers between 1996 and 1999, versus 19,158 claims in a previous study for 1990 through 1995. The most recent study reported that 6,686 lawsuits against lawyers were settled, versus 4,897 suits in the earlier study.

Of those lawsuits that went to trial, there were 289 judgments for the plaintiffs in the most recent study compared to 29 judgments for the plaintiffs in the earlier study. According to the most recent study, 13.8 percent of the claims resulted in payouts by lawyers or law firms of more than $10,000.
